IS “AN EYE FOR AN EYE” A GOOD STARTING POINT FOR DETERMINING AN APPROPRIATE PUNISHMENT? WHY OR WHY NOT?

An “eye for an eye” is not the best way forward, and it leads to violation of the rights of persons.
In my view, “an eye for an eye” doesn’t fall within the definitive scope of impunity, nor retribution.
Reason being, it predetermine punishments and unwanted verdicts for a person, without him or her being proven guilty by law, the jurisprudence of law. This action in my opinion is generally, the breading of mob violence or actions void of the justice system.
In as much as, individuals must be punished for their wrong doings, as a means of prohibiting crimes, it is also a necessity, that respect for the Human Rights of persons, and of the rule of law be obeyed, giving credence except, to the justice or cri let alone, allowing various legal teams in court, to prove beyond all reasonable doubts, that actions were perpetrated, judgments are final, rulings are merited and crimes facilitated.
There could be no other place, to arbitrate an offence when it had gone through the justice system, and final verdicts are passed.
With that being said, when proven guilty, after facing charges and being provided the right to his or her legal Counsels and Attorney, a person can be penalized by law, and not by any form or means of “an eye, for an eye”, which are sometimes very violent and devastating, giving rise to other crimes being perpetrated.
One quote worthwhile, that in all things we must ascribe to, as with having a legal mindset, is that,” what isn’t done legally - isn’t done at all”. And the justice system must be the only place for opinions which adjudicate crimes, by virtues of and relating to, the legal means.
In places where this practice of “an eye for an eye” is found, there is breakdown in the justice system and of the rule of law, crimes are merely perpetrated and violence is the order of the day. And so, we can safely say that these states are on the verge of, or are already considered, failed-states.
Unlike now, years back under the era of former President, Charles Taylor, Liberia was considered a failed-state, reason being, the justice system was avoided, there were execution style killings, as well as the perpetration of heinous crimes throughout the country, and these we can say could be presumed to be “an eye, for an eye”.
In conclusion, I am proud to say that the justice system exposes crimes and gives deserving punishment, by the passing of a verdict.
